<p class="MsoNormal">Moral policing at workplace with different rules for different employees landed Yuasa Battery in soup. In a case filed over <a href="http://www.direct.gov.uk/en/Employment/RedundancyAndLeavingYourJob/Dismissal/DG_10026692">unfair dismissal</a> by employee Keith Bodman, Yuasa made an out of court settlement to rest the case midway through the trial. The sum offered for settlement is reported to be at least &#163;10,000. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">The case of unfair dismissal was the outcome of a trivial matter. Keith Bodman who was working as a shop steward at Yuasa Battery for 16 years was fired over usage of bad language. In fact, he had told his boss to f*** off on repeated invasion of privacy by asking about matters of private life. The manager took offence and dismissed him. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">It was surprising as using foul language was commonplace at Yuasa and meant no offense. Despite the support of the colleagues and line manager who vouched for the harmlessness of the bad language, the company did not give his job back. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">Keith Bodman had been working with Yuasa for over 16 years and had a clean record. He also had a 100% attendance record. Disappointed Bodman went to Unite, the union. Unite appointed Thompson Solicitors to take the case to <a href="http://www.employmenttribunals.gov.uk/">Employment Tribunal</a>. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">Thompsons filed a case of unfair dismissal on behalf of Bodman. Investigations also revealed that there were cases of employees using foul language earlier too. Yuasa had just issued a written warning of disciplinary action kept on record for six months. That was the maximum penalty. It was obvious that the company had decided to be harsh with Bodman though the culture of the company was clearly to take foul language in stride. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">Thompsons argued at the Tribunal that Keith Bodman was treated differently than the other employees. While the case was still proceeding, Yuasa decided to settle the claim out of court.</p>

<p class="MsoNormal">Other firms that pleaded guilty to the same charges previously were Hertfordshire Oil Storage Ltd., Motherwell Control Systems 2003 Ltd and Total and British Pipeline Agency Ltd. Hertfordshire Oil Storage Ltd. was found guilty on two charges, one for neglecting to stop a major accident and the other for polluting the surrounding areas and controlled water in Buncefield. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">HSE and the Environment Agency issued a joint statement which stated that the Buncefield case was the biggest and most complicated criminal inquiry they had worked together. It came about after many hundreds of hours of painstaking forensic investigation.</p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">The organizations had decided to take legal action against the companies because they had failed to protect members of the public, workers and the environment. They stated that the <a href="http://news.bbc.co.uk/1/hi/uk/4517962.stm">Buncefield fire</a> was the largest fire in peacetime <st1:place w:st="on">Europe</st1:place> which had resulted in injury to people and damage to the environment. </p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">They added that although the scale of the explosion and fire was huge, miraculously no one had died. This could change in future unless the high hazard industries truly learnt a lesson from the Buncefield accident. The verdict will be out by 16 July.</p>
